Opening a Business in Carlton

 

 

We are pleased to welcome your business to the City of Carlton! We hope that the information provided here will make the process of opening your business a little easier. To begin, learn about the type of business license you might need. The city has 4 instances where a business license will be required: general, home occupation, transient merchant and vacation rental.

 

 

Business License Forms and Applications

General Business

A business license is required when selling any goods or service, soliciting business or offering goods or services for sale or hire, and/or acquiring or using any vehicle or premises in the city for business purposes. Application for a license shall be made annually beginning within 15 days after commencing business in the city and renewed effective January 1 each year. All businesses must comply with zoning and other regulations that have been adopted by the city, county and/or state.

Steps to acquiring a Business License:

  1. Review zoning regulations to ensure your business and location are an approved use. Check with the City Planner if you have planning or zoning questions.
     
  2. Register your business name with the State of Oregon. For more help on starting a new business, the State has a handy checklist: How to Start a Business in Oregon.
     
  3. If your business has any food or beverage related activities, please review the handout from the Department of Agriculture below.
     
  4. Complete the business license application listing all requested information.
     
  5. Bring the completed business license application, copy of the name registration with the state (or copy of stamped Articles of Incorporation), a copy of floor plans of the business (showing the size and location of exit doors, bathrooms, counter heights and display cases) and a check for $100.00 to Carlton City Hall.
     
  6. Please review the sign ordinance to determine if the sign you wish to use requires a Sign Permit.
     
  7. The city imposes a 7% Transient Room Tax on lodging rented for less that 30 days duration. The tax is used for tourism related purposes and general government purposes as stated in the Carlton Municipal Code, Chapter 3.16. All hotels, bed and breakfast and vacation rentals and any other type of transient lodging establishments, are required to collect a room tax from their guests and remit it to the City on a quarterly basis. Please submit the T.R.T. form, along with your room tax check, to City of Carlton.

Home Occupation

A home occupation is a business carried on by a resident of a dwelling as a secondary use within the same dwelling. The business needs to be conducted in such a way that the outward appearance does not manifest any characteristics of a business nor infringe upon the right of neighboring residents to enjoy the peaceful occupancy of their homes. Home occupations are allowed as an accessory use to any residential use in the city, subject to obtaining a business license and conformance with the standards for home occupations. A home occupation that is not fully enclosed within a primary structure, or exceeds one or more of the home occupation standards, may be permitted subject to review and approval of a conditional permit.

Steps to acquiring a Business License: 

  1. Review City Ordinance 17.124 and complete the checklist below to ensure that you comply. If the home occupation is not fully enclosed within a primary structure, or it exceeds one or more of the home occupation standards, please submit a Home Occupation Permit application, along with the appropriate fee, to Carton City Hall.

  3. If your business has any food or beverage related activities, please review the handout from the Department of Agriculture.

  5. Bring the approved Home Occupation Permit, Business License application, copy of the name registration with the state (or copy of stamped Articles of Incorporation) and a check for $100.00 to Carlton City Hall.

Transient or Temporary Business

“Transient merchant” means any person, either as a principal or agent, who sells goods, wares, services, or merchandise at a fixed temporary location or door-to-door or otherwise conducts business for a fixed temporary period of time.

After reviewing the City Ordinance 5.24 to be sure that you comply, bring the completed Transient Merchant License application and a check for $25.00 to Carlton City Hall.

Vacation Rentals

A vacation rental is a furnished house or duplex, owned by a private individual that is rented on a daily or weekly basis. Single family dwellings may be used as a vacation rental dwelling in the following zones, upon obtaining a vacation rental dwelling permit: Residential Low Density (R-1), Manufactured Home (MH), Mixed Density (MX), Residential Medium Density (R-2) and Residential Medium-High Density (R-3). A duplex may be used as a vacation rental in the R-1, R-2, R-3 and MX zones subject to receiving conditional use permit approval.

Steps to acquiring a Business License: 

  1. Review City Ordinance 17.125 to ensure that you comply. Submit a Vacation Rental Dwelling Permit application, along with the appropriate fee, to Carton City Hall. Please review and complete the checklist thoroughly before submitting the application for approval.
     
  2. Register your business name with the State of Oregon. For more help on starting a new business, the State has a handy checklist: How to Start a Business in Oregon.
     
  3. Complete the Business License Application listing all requested information.
     
  4. Bring a copy of the approved Vacation Rental Dwelling Permit, the completed Business License Application, copy of the name registration with the state (or copy of stamped Articles of Incorporation), a copy of the buildings floor plans, and a check for $100.00 to Carlton City Hall.
     
  5. Please review the sign ordinance to determine if the sign you wish to use requires a Sign Permit.
